1. Introduction

1.1 Purpose of These Terms
These Terms and Conditions (the “Terms”) govern all bookings, services, and Expeditions offered by CRWild Expeditions (“CRWild”, “we”, or “us”). By making a booking with CRWild, the Guest (“you”) expressly agrees to be legally bound by these Terms.

1.2 Binding Nature of the Agreement
Confirmation of any booking constitutes a binding contract between CRWild and the Guest. If the booking is made on behalf of other participants, the person making the booking (“Lead Guest”) is deemed to have the authority to accept these Terms on their behalf, and all participants are bound by them.

1.3 Nature of Services and Assumption of Risk
CRWild specializes in adventure travel, ecotourism, and herping expeditions. These services frequently involve remote locations, outdoor environments, and physical activities that carry inherent risks, including accidents, injuries, illnesses, and logistical disruptions. By booking with CRWild, you acknowledge and voluntarily accept these risks as a condition of participation.

1.4 Jurisdiction and Governing Law
This Agreement is governed exclusively by the laws of Costa Rica. Any dispute, claim, or controversy arising from or relating to the booking or participation in an Expedition shall be submitted to binding arbitration before the Costa Rican Chamber of Commerce, seated in San José, Costa Rica.

1.5 Acceptance of Terms
By submitting a booking request, paying a deposit, or participating in any Expedition, you confirm that you have read, understood, and accepted these Terms in their entirety. If you do not agree with these Terms, you must not proceed with a booking.

2. Booking Contract

2.1 Formation of Contract
A binding travel contract (“Contract”) is created between CRWild Expeditions (“CRWild”) and the Guest upon CRWild’s issuance of a written booking confirmation following receipt of the required deposit or full payment. By entering into this Contract, the Guest expressly agrees to be bound by these Terms and Conditions.

2.2 Authority of the Lead Guest
Where a booking is made on behalf of other participants, the individual making the booking (the “Lead Guest”) is deemed to have the authority to accept these Terms on behalf of all participants. The Lead Guest assumes full responsibility for all obligations under this Contract, including payment, accuracy of information, and communication with CRWild.

2.3 Contractual Parties
The Contract is exclusively between the Guest(s) listed in the booking confirmation and CRWild, a Costa Rican company organized and operating under the laws of Costa Rica. Services provided by Third-Party Suppliers (including, but not limited to, airlines, accommodations, and transport providers) are governed by their own terms and conditions, and CRWild shall not be liable for their acts, omissions, or failures.

2.4 Accuracy of Information
The Guest must review all booking documents and confirmations upon receipt and immediately notify CRWild of any discrepancies. CRWild shall not be held liable for errors, omissions, or expenses resulting from the Guest’s failure to report inaccuracies in a timely manner.

2.5 Binding Effect
By confirming a booking, the Guest acknowledges having the legal capacity to enter into this Contract and confirms that they have reviewed and understood the itinerary, requirements, inherent risks, and obligations associated with the Expedition.

2.6 Governing Law
This Contract shall be governed exclusively by the laws of Costa Rica. Any disputes shall be resolved through binding arbitration under the rules of the Costa Rican Chamber of Commerce in San José, Costa Rica.

3. Booking on Behalf of Others

3.1 Authority of the Lead Guest
When a booking is made on behalf of other participants, the individual making the booking (the “Lead Guest”) is deemed to be the authorized representative of all participants listed. By submitting the booking, the Lead Guest confirms that they have obtained full consent and authority from each participant to:
(a) provide personal information, including medical data, on their behalf;
(b) accept these Terms and Conditions on their behalf; and
(c) make all necessary payments related to the booking.

3.2 Responsibilities of the Lead Guest
The Lead Guest is solely responsible for:
(a) ensuring all payments are made in accordance with CRWild’s deadlines;
(b) communicating all booking details, requirements, and updates to every participant;
(c) providing complete and accurate information for all participants; and
(d) promptly notifying CRWild of any changes or cancellations.

3.3 Liability and Indemnification
CRWild shall not be liable for errors, omissions, or false information provided by the Lead Guest. The Lead Guest agrees to indemnify and hold CRWild harmless against any claims, losses, damages, or costs (including legal fees) arising from:
(a) failure to obtain proper consent from participants;
(b) providing inaccurate or incomplete information; or
(c) disputes among participants regarding the booking.

3.4 Binding Effect
All participants included in the booking are deemed to have accepted these Terms. The Lead Guest acknowledges that CRWild is entitled to rely fully on the Lead Guest’s representations and shall not be required to seek confirmation directly from other participants.

4. Representation of Health and Safety

4.1 Guest Declarations
By confirming a booking, each Guest represents and warrants that they:
(a) have reviewed the itinerary and selected an Expedition suitable for their physical and mental condition;
(b) do not suffer from any condition that may create a hazard to themselves, other participants, or CRWild staff;
(c) have consulted a licensed physician, as appropriate, regarding their fitness to participate in the planned activities; and
(d) will immediately notify CRWild of any change in health status or safety-related circumstance before or during the Expedition.

4.2 Obligation to Comply with Safety Instructions
Guests must follow all safety rules, written instructions, and oral directions provided by CRWild or its Third-Party Suppliers. This includes, but is not limited to, the use of mandatory safety equipment such as seatbelts, helmets, life jackets, and harnesses.

4.3 Right to Refuse or Terminate Participation
CRWild reserves the unilateral right to refuse service, cancel a booking, or remove a Guest from an Expedition if:
(a) the Guest fails to comply with safety rules;
(b) the Guest’s condition or behavior poses a risk to themselves, others, or the operation of the Expedition; or
(c) the Guest acts in a disruptive, negligent, or unsafe manner.
In such cases, no refund, credit, or compensation will be provided, and all additional costs incurred (including evacuation, transportation, or alternative arrangements) will be borne exclusively by the Guest.

4.4 Assumption of Risk
Guests expressly acknowledge that Expeditions may involve visiting remote, rural, or natural environments where medical care, security, and infrastructure may be limited or inadequate. By participating, Guests voluntarily assume all inherent risks, including but not limited to accidents, injuries, illnesses, wildlife encounters, and environmental hazards.

4.5 Release of Liability
CRWild shall not be liable for any loss, injury, illness, or death resulting from the Guest’s failure to comply with safety instructions, from undisclosed medical conditions, or from risks inherent in adventure and nature-based travel.

5. Required Medical Information

5.1 Mandatory Disclosure
Guests are required to disclose fully and accurately all medical information that may affect their ability to participate in an Expedition, including but not limited to pre-existing conditions, medications, allergies, mobility limitations, and psychological conditions. Failure to disclose such information shall release CRWild from any liability arising from undisclosed medical conditions.

5.2 Medical Form Requirement
For certain Expeditions, CRWild may require completion of its official Medical Form, signed by a licensed physician. The form must be submitted by the deadline established for final payment.

5.3 Accuracy and Completeness
The Guest warrants that all medical information provided is true, accurate, and complete. CRWild shall not be responsible for consequences arising from false, incomplete, or misleading information provided by the Guest.

5.4 Right to Refuse or Remove Guests
CRWild reserves the right, at its sole discretion, to:
(a) refuse participation prior to departure, or
(b) remove a Guest from an Expedition in progress,
if the Guest’s medical condition poses a risk to themselves, to other participants, or to the safe execution of the Expedition. In such cases, no refund or compensation shall be provided.

5.5 Costs and Liability
All additional costs incurred as a result of a Guest’s medical condition (including evacuation, hospitalization, or repatriation) shall be borne exclusively by the Guest. CRWild is not liable for any such expenses, even if they exceed the limits of the Guest’s insurance coverage.

5.6 Privacy of Information
All medical information will be handled according to CRWild’s Privacy Policy. However, CRWild reserves the right to share relevant medical information with staff, guides, or Third-Party Suppliers when necessary for safety.

5.7 Limitations of Medical Care
The Guest acknowledges that Expeditions may take place in remote or developing regions where medical facilities may be limited, inadequate, or below international standards. CRWild makes no representations or warranties regarding the availability, adequacy, or quality of medical treatment in any location.

6. Pregnancy

6.1 Disclosure Obligation
Pregnancy is deemed a medical condition. Guests must disclose their pregnancy status at the time of booking. Failure to disclose pregnancy releases CRWild from any liability arising from complications during the Expedition.

6.2 Restrictions
(a) Guests who are 24 weeks pregnant or more on the Expedition start date, or who will reach the 24th week during the Expedition, are strictly prohibited from participating.
(b) Airlines, local providers, and Third-Party Suppliers may impose additional restrictions. Compliance with such requirements is the sole responsibility of the Guest.

6.3 Medical Clearance Requirement
Guests under 24 weeks pregnant may be required to present a physician’s certificate confirming their fitness to travel. CRWild reserves the right to refuse participation if such certification is not provided or if, in CRWild’s judgment, participation poses a safety risk.

6.4 Assumption of Risk
Guests acknowledge and accept that CRWild shall not, under any circumstances, be held liable for pregnancy-related complications, incidents, or medical conditions arising before, during, or after the Expedition. All risks associated with pregnancy and travel are expressly assumed by the Guest.

6.5 Right to Refuse Service
CRWild reserves the unilateral right to refuse or terminate participation of a pregnant Guest if their condition poses a risk to themselves, to other participants, or to the safe operation of the Expedition. No refunds or compensation shall be due in such cases.

7. Special Requirements and Dietary Requests

7.1 Mandatory Disclosure
All special requirements, including but not limited to medical conditions, mobility limitations, food allergies, or dietary restrictions, must be disclosed to CRWild in writing at the time of booking. Failure to disclose such requirements shall release CRWild from any liability arising from the inability to accommodate them.

7.2 No Guarantee
While CRWild will use reasonable efforts to communicate special requirements to relevant Third-Party Suppliers (including but not limited to accommodations, restaurants, and transport providers), CRWild makes no warranty or guarantee that such requests will be met.

7.3 Allergen and Dietary Limitations
(a) Meals may be prepared in environments where allergens are present. CRWild cannot ensure that any meal or food product is completely free from allergens.
(b) The availability of vegetarian, vegan, gluten-free, or other special meal options is subject to local limitations and is outside CRWild’s control.
(c) Guests are solely responsible for evaluating whether food and beverage offerings meet their personal dietary requirements.

7.4 Limitation of Liability
CRWild shall not be held liable, under any circumstances, for:
(a) the failure to meet any dietary or special requirement;
(b) cross-contamination of allergens or lack of specific food alternatives;
(c) any direct or indirect damages, illness, inconvenience, or expenses resulting from unmet requests.

7.5 Non-Contractual Nature of Requests
Special requirements and dietary requests do not constitute contractual obligations and are expressly excluded from these Terms unless CRWild confirms them in writing as a guaranteed condition of booking.

8. Activity Level and Accessibility

8.1 Guest Responsibility
It is the sole responsibility of the Guest to review the itinerary in detail and determine whether they are physically and mentally capable of participating in the chosen Expedition. CRWild does not provide medical advice, nor does it evaluate the suitability of an Expedition for any Guest.

8.2 No Obligation to Provide Assistance
CRWild staff and Third-Party Suppliers are not trained or authorized to provide personal assistance (including lifting, pushing, carrying, or medical support). Guests requiring assistance must travel with a companion who can provide such support at their own expense.

8.3 Accessibility Limitations
Due to the nature of adventure travel and the environments visited:
(a) Expeditions may not be suitable for persons with mobility restrictions, physical disabilities, or chronic health conditions.
(b) Wheelchair accessibility, specialized equipment, or medical facilities may be unavailable.
(c) Local conditions (terrain, infrastructure, climate) may significantly limit accessibility.

8.4 Medical Clearance
For certain Expeditions, CRWild may require Guests to provide written clearance from a licensed physician certifying their fitness to participate. CRWild reserves the right to deny participation if such clearance is not provided.

8.5 Assumption of Risk
By booking, Guests acknowledge that accessibility limitations are inherent to adventure travel and that CRWild shall not be liable for any direct or indirect consequences arising from such limitations, including the inability to complete activities, changes to itinerary, or exclusion from portions of the Expedition.

9. Service Providers and Independent Activities

9.1 Third-Party Service Providers
CRWild may contract, license, or otherwise engage independent third-party suppliers (“Third-Party Suppliers”) to provide services in connection with an Expedition, including but not limited to accommodations, transportation, meals, excursions, and activities. These suppliers operate under their own terms and conditions, which are legally binding upon the Guest.

9.2 Limitation of Liability
CRWild acts solely as an intermediary between the Guest and Third-Party Suppliers. CRWild does not supervise, control, or guarantee the actions, omissions, or performance of such suppliers and expressly disclaims liability for:
(a) delays, accidents, inconvenience, or service disruptions;
(b) illness, injury, emotional distress, or death;
(c) loss, theft, or damage to property;
(d) quality, safety, or adequacy of services provided by Third-Party Suppliers.

9.3 Guest Responsibility for Independent Activities
If the Guest chooses to participate in any activity, excursion, or service not arranged, contracted, or operated by CRWild, such activity shall be undertaken entirely at the Guest’s own risk. CRWild shall have no control, responsibility, or liability whatsoever regarding such independent activities.

9.4 Contractual Relationships
Airline tickets, hotel reservations, transportation services, and other supplier agreements constitute independent contracts between the Guest and the relevant provider. CRWild shall not be liable for any terms, conditions, or obligations arising from such agreements.

9.5 Release of Liability
By booking with CRWild, the Guest releases CRWild from any and all claims, damages, or demands arising from the conduct, negligence, or default of Third-Party Suppliers or from participation in independent activities not arranged by CRWild.

10. Age Requirements

10.1 Definition of Minor
For purposes of these Terms, any individual under the age of 18 years at the time of departure is considered a “Minor.”

10.2 Minimum Age
Unless otherwise specified for a particular Expedition, the minimum age for participation is 12 years. CRWild reserves the right to refuse participation to any Minor who does not meet this requirement.

10.3 Adult Supervision
All Minors must be accompanied at all times by a parent or a duly authorized legal guardian (“Responsible Adult”). One Responsible Adult may accompany a maximum of two Minors.

10.4 Legal Consents and Documentation
It is the sole responsibility of the Responsible Adult to secure and carry all legal documents required for a Minor’s participation, including but not limited to parental consents, custody authorizations, travel permits, and medical authorizations. CRWild shall not be held liable for denied boarding, entry, or participation resulting from failure to obtain proper documentation.

10.5 Responsibility of the Accompanying Adult
The Responsible Adult accepts full and joint responsibility for the conduct, supervision, and safety of the Minor(s) under their care and expressly agrees to these Terms on behalf of such Minor(s).

10.6 No Custodial Responsibility
CRWild does not provide child-care or custodial services. CRWild and its staff shall not be held liable for supervision, control, or direct responsibility over Minors at any time during the Expedition.

10.7 Right to Refuse Service
CRWild reserves the right to deny participation to any Minor if, in its sole discretion, the Minor’s participation poses safety, operational, or legal concerns.

11. Insurance Requirements

11.1 Mandatory Travel Insurance
All Guests are required to obtain and maintain valid travel insurance covering the entire duration of their Expedition. Such insurance must provide minimum coverage of USD $200,000 for:
(a) emergency medical expenses;
(b) evacuation and repatriation costs; and
(c) personal injury or accidental death.

11.2 Proof of Insurance
Guests must provide written proof of insurance coverage before the Expedition commences. CRWild reserves the right to refuse participation if proof of adequate insurance is not presented. In such cases, no refund will be granted.

11.3 Recommended Coverage
In addition to mandatory coverage, CRWild strongly recommends that Guests obtain insurance that covers:
(a) trip cancellation, interruption, or curtailment;
(b) loss, theft, or damage to baggage and personal property; and
(c) delays, missed connections, or additional accommodation and transportation expenses.

11.4 Guest Responsibility
It is the Guest’s sole responsibility to:
(a) ensure that their insurance policy is valid for the destination(s) and activities included in the Expedition;
(b) disclose all relevant details to the insurer to secure appropriate coverage; and
(c) understand and comply with the terms of their policy.

11.5 Limitation of Liability
CRWild shall not be liable for:
(a) any costs or expenses not covered by the Guest’s insurance;
(b) claims denied by the Guest’s insurer;
(c) any losses, damages, injuries, or delays that could have been covered by insurance but were not due to the Guest’s failure to obtain adequate coverage.

11.6 Financial Responsibility
All expenses arising from medical treatment, evacuation, hospitalization, repatriation, or any other emergency remain the sole responsibility of the Guest, regardless of the adequacy of insurance coverage.

12. Prices, Deposits, and Payments

12.1 Prices and Taxes
All prices published by CRWild are expressed in U.S. Dollars (USD), unless otherwise indicated, and are exclusive of applicable taxes, surcharges, and fees. Prices are subject to change at any time prior to booking confirmation.

12.2 Deposits
(a) At the time of booking, a non-refundable deposit of USD $600 per person, per Expedition (or a higher amount for tailor-made services, as specified by CRWild) must be paid.
(b) If the booking is made 90 days or less prior to departure, full payment is due at the time of booking.
(c) Deposits are strictly non-refundable, but may qualify as a “Lifetime Deposit” under section 12.6.

12.3 Final Payment
The balance of the total price is due no later than 60 days prior to departure. Failure to pay the balance by the deadline may result in cancellation of the booking by CRWild, with loss of the deposit and the application of cancellation penalties.

12.4 Late Bookings

For any booking made within 60 days prior to the Expedition departure date, full payment is required at the time of booking.

Such payments are strictly non-refundable, regardless of cancellation reason, including but not limited to personal circumstances, medical conditions, flight disruptions, or force majeure events.

No Lifetime Deposit will apply to late bookings.

12.5 Price Adjustments and Surcharges
After booking confirmation, CRWild reserves the right to impose surcharges due to:
(a) increases in transportation or fuel costs;
(b) changes in local operator fees, port charges, or embarkation/disembarkation taxes;
(c) government actions, new taxes, or currency fluctuations.

Surcharges will only be applied if the total increase exceeds 2% of the original price. If the increase exceeds 13% of the original price, the Guest may:
(i) accept the revised price; or
(ii) cancel the booking and receive a full refund of all payments made (excluding the non-refundable deposit).

12.6 Lifetime Deposits
If a Guest cancels a booking (for reasons other than non-payment or breach of these Terms), the deposit will be held as a Lifetime Deposit:
(a) Lifetime Deposits do not expire and may be applied toward a future CRWild Expedition.
(b) Lifetime Deposits have no cash value and are non-refundable.
(c) Only one Lifetime Deposit may be applied per person, per booking.
(d) The new Expedition must be of equal or greater value than the original.

12.7 Payment Errors and Bank Transfers
The Guest is solely responsible for ensuring accuracy in bank transfers and payment details. CRWild shall not be held liable for delays, fees, or losses caused by incorrect, incomplete, or rejected transfers.

12.8 Third-Party Fees
CRWild shall not be responsible for charges imposed by financial institutions, credit card companies, or third-party processors. Such fees are payable exclusively by the Guest.

13. Cancellations by the Guest

13.1 Notification Requirement
All cancellations must be communicated to CRWild in writing (by email or certified letter). The date of receipt of such notice by CRWild will determine the applicable cancellation penalties.

13.2 Cancellation Penalties – Expeditions
(a) 90 days or more prior to departure:
The non-refundable deposit will be retained by CRWild as a Lifetime Deposit, and all other payments will be refunded.

(b) Between 60 and 89 days prior to departure:
The non-refundable deposit will be retained, and 50% of the remaining balance will be refunded.

(c) 59 days or less prior to departure:
The non-refundable deposit will be retained, and no refund of the remaining balance will be issued.

13.3 Cancellation of Additional Services
For optional services booked directly with CRWild (e.g., airport transfers, pre-/post-expedition accommodations, “My Own Room” option, or optional activities):
(a) 90 days or more prior to departure: 100% refund.
(b) 30 days or less prior to departure: no refund.

13.4 Non-Refundable Services
The following are strictly non-refundable under any circumstances:
(a) confirmed flights and transportation;
(b) accommodation and meals already paid in advance;
(c) daily guide fees once the Expedition has commenced;
(d) any expenses already incurred by CRWild on behalf of the Guest.

13.5 Lifetime Deposit
If cancellation is not the result of non-payment, misconduct, or breach of these Terms, the deposit will be held as a Lifetime Deposit, subject to the conditions in section 12.6.

13.6 Guest Liability for Costs
The Guest shall remain liable for all costs incurred by CRWild or its providers as a direct result of the cancellation, including but not limited to guides’ compensation, domestic and international flights, accommodation, meals, permits, and transportation.

13.7 No Refund for Early Departure
If the Guest voluntarily leaves an Expedition after commencement, no refund, credit, or reimbursement will be issued for unused services.

13.8 Cancellations Attributable to the Guest
If the Expedition is canceled or interrupted as a direct result of the Guest’s failure, omission, or misconduct, such cancellation shall be deemed, for all legal and contractual purposes, a cancellation by the Guest under this Section.
This includes, but is not limited to:
(a) failure to pay the balance by the established deadlines;
(b) lack of required travel documentation or insurance;
(c) false, omitted, or inaccurate mandatory medical information;
(d) failure to comply with safety instructions;
(e) disruptive, unlawful, or unsafe conduct that forces suspension or cancellation of the Expedition.

In such cases, the Guest shall have no right to any refund, and shall remain liable for all costs incurred by CRWild or its suppliers as a result of such failure.

14. Cancellations by CRW and Guaranteed Departures

14.1 Guaranteed Departures
A departure date for an Expedition is considered guaranteed once at least one valid booking secured with a deposit has been made. Guaranteed departures remain subject to the provisions of Sections 14.3 and 14.4 (Force Majeure and Safety Concerns).

14.2 Right of CRWild to Cancel Prior to Departure
CRWild reserves the right to cancel any Expedition at any time prior to departure for reasons including, but not limited to:
(a) insufficient enrollment rendering the Expedition economically unfeasible;
(b) operational concerns;
(c) safety, health, or security considerations; or
(d) errors in pricing or published information.

14.3 Guest Options in Case of Cancellation by CRWild (Non-Force Majeure)
If CRWild cancels an Expedition for reasons other than Force Majeure or the Guest’s own misconduct, the Guest may choose one of the following:
(a) transfer payments made to a substitute Expedition of equal value;
(b) transfer to an Expedition of lesser value (with a refund of the difference); or
(c) receive a refund of all payments made, limited to amounts not already prepaid to Third-Party Suppliers.

14.4 Force Majeure and Safety Cancellations
If cancellation occurs due to events beyond CRWild’s reasonable control (including but not limited to natural disasters, epidemics, pandemics, governmental restrictions, civil unrest, armed conflict, or terrorism), CRWild may offer:
(a) rescheduling of the Expedition;
(b) application of payments made toward a future booking; or
(c) partial refund, limited by non-recoverable costs already paid to Third-Party Suppliers.
In such cases, CRWild shall have no further liability.

14.5 Exclusion of Liability for Indirect Losses
CRWild shall not be liable for any indirect or consequential losses resulting from cancellation, including but not limited to: visas, vaccinations, flights, accommodations, lost income, or loss of enjoyment.

14.6 Right to Cancel During Expedition
CRWild reserves the right to terminate or modify an Expedition in progress if, in its sole discretion, continuation is deemed unsafe, illegal, or materially impaired. In such cases, refunds shall be issued only for unused services that CRWild can recover from Third-Party Suppliers.

14.7 Guest Misconduct or Breach
If cancellation is caused by the Guest’s misconduct, negligence, or breach of these Terms, CRWild reserves the right to cancel participation immediately, with no refund or compensation, and the Guest shall remain liable for all related costs.

15. Force Majeure and National Security

15.1 Definition of Force Majeure
For purposes of this Agreement, “Force Majeure” includes, but is not limited to: acts of God, natural disasters, pandemics, epidemics, government restrictions, strikes, labor disputes, mechanical failures, fire, extreme weather, civil disturbances, armed conflicts, acts of terrorism, riots, revolutions, or any event beyond the reasonable control of CRWild.

15.2 National Security Events
“National Security Reasons” shall include threats or events that compromise the safety of Guests or staff, including but not limited to: armed conflict, terrorism, organized crime, civil unrest, political instability, or criminal activity, as determined by local or international authorities.

15.3 Right to Cancel, Modify, or Suspend
CRWild reserves the unilateral right to cancel, postpone, or modify any Expedition, in whole or in part, if such action is deemed necessary due to Force Majeure or National Security events.

15.4 Refunds and Future Credits
(a) In such cases, CRWild may, at its discretion, apply payments made to a future Expedition, issue a partial refund limited to recoverable amounts from Third-Party Suppliers, or provide a substitute itinerary.
(b) The non-refundable deposit and any amounts already paid to Third-Party Suppliers that cannot be recovered shall not be refunded.

15.5 Limitation of Liability
CRWild shall not be liable for:
(a) any indirect, consequential, or incidental damages, including but not limited to lost income, lost enjoyment, or additional costs incurred by the Guest;
(b) expenses relating to visas, vaccinations, non-refundable flights, or accommodations;
(c) failure to perform obligations if such failure results directly or indirectly from a Force Majeure or National Security event.

15.6 Guest Acknowledgment
By booking with CRWild, the Guest acknowledges and accepts that travel may be disrupted or canceled due to Force Majeure or National Security reasons, and expressly waives any claims against CRWild beyond the limited remedies described herein.

16. Flexibility and Modifications

16.1 Inherent Flexibility of Expeditions
The Guest acknowledges that adventure travel requires flexibility. Itineraries, routes, accommodations, transportation, activities, wildlife sightings, and schedules are subject to change without prior notice due to weather conditions, natural events, governmental actions, safety concerns, or operational requirements.

16.2 Authority of CRWild
The Guest agrees to abide by the authority of CRWild, its guides, and staff, who may modify or cancel any part of the Expedition if deemed necessary for the safety, comfort, or well-being of Guests, staff, or the environment.

16.3 Non-Liability for Modifications
CRWild shall not be liable for:
(a) changes to accommodations, transport, meals, or activities;
(b) failure to achieve specific outcomes (such as wildlife encounters or weather-dependent activities);
(c) delays, rerouting, or itinerary changes beyond CRWild’s control.

16.4 No Right to Refunds
Modifications, substitutions, or omissions of any part of the Expedition shall not entitle the Guest to a refund, credit, or compensation of any kind.

16.5 Guest Responsibility for Costs
Any additional expenses incurred by the Guest as a result of modifications (e.g., lodging, meals, or transport due to weather or safety changes) are the sole responsibility of the Guest, unless expressly covered by CRWild in writing.

17. Airfare and Travel Arrangements

17.1 Exclusion of International Airfare
Unless expressly stated in writing, the price of an Expedition does not include international airfare, airport transfers, or travel to and from the Expedition’s meeting point.

17.2 Responsibility of the Guest
The Guest is solely responsible for arranging and purchasing international flights, complying with airline regulations, and ensuring arrival at the designated meeting point on time. CRWild is not responsible for missed flights, delays, cancellations, lost baggage, or denial of boarding for any reason.

17.3 Liability Disclaimer
CRWild shall not be liable for:
(a) costs incurred due to missed flights, schedule changes, or flight cancellations;
(b) additional accommodation, meals, or transport required due to flight disruptions;
(c) airline insolvency, strikes, or operational failures.

17.4 Connecting Travel and Itinerary Adjustments
If the Guest fails to arrive at the designated starting point of the Expedition on time due to flight delays or cancellations, the Guest remains responsible for all costs associated with rejoining the group. CRWild is under no obligation to delay or modify the Expedition itinerary to accommodate missed connections.

17.5 Optional Flights or Arrangements Booked Through CRWild
If CRWild assists with airfare, hotel bookings, or transfers, such services are arranged through Third-Party Suppliers and are subject to their own terms and conditions. CRWild acts solely as an intermediary and assumes no liability for the services provided.

17.6 Travel Documentation
The Guest is responsible for obtaining all necessary passports, visas, permits, vaccinations, and travel documents. CRWild is not liable for denied boarding or entry due to incomplete or invalid documentation.

18. Pre- and Post-Trip Extensions and Extra Arrangements

18.1 Optional Nature
Any pre-trip or post-trip extensions, additional nights of accommodation, optional excursions, or extra services (“Extra Arrangements”) are not included in the standard Expedition price unless expressly confirmed in writing by CRWild.

18.2 Third-Party Suppliers
Extra Arrangements may be organized by CRWild through independent Third-Party Suppliers. Such services are subject to the terms and conditions of the supplier, and CRWild acts solely as an intermediary.

18.3 No Guarantee of Availability
All Extra Arrangements are subject to availability at the time of booking. CRWild does not guarantee confirmation of specific hotels, activities, or services.

18.4 Limitation of Liability
CRWild shall not be liable for:
(a) cancellations, delays, or modifications made by Third-Party Suppliers;
(b) variations in quality or standards of accommodations, meals, or services;
(c) accidents, losses, or damages occurring during Extra Arrangements.

18.5 Separate Payment and Non-Refundability
All Extra Arrangements must be paid in full at the time of confirmation. Payments for Extra Arrangements are non-refundable, unless expressly stated otherwise in writing by CRWild.

18.6 Independent Participation
If the Guest participates in Extra Arrangements not booked through CRWild, such participation is entirely at the Guest’s own risk. CRWild assumes no responsibility for services independently contracted by the Guest.

19. Complaints and Claims

19.1 Immediate Notification Requirement
If the Guest has a complaint during the Expedition, they must notify the CRWild guide or representative immediately so that reasonable efforts can be made to resolve the issue on-site. Failure to provide immediate notice may reduce or extinguish the Guest’s right to claim compensation.

19.2 Formal Written Complaint
All complaints must also be submitted in writing to CRWild within 30 calendar days of the Expedition’s completion. Complaints received after this deadline will not be accepted or processed.

19.3 Evidence Requirement
Any claim must be supported by relevant documentation and evidence (e.g., photographs, receipts, witness statements). Unsupported or unsubstantiated claims will not be considered.

19.4 Limitation of Liability
CRWild’s liability for any valid claim shall not exceed the total amount actually paid by the Guest for the Expedition, excluding insurance, flights, and optional services.

19.5 Exclusion of Indirect Damages
CRWild shall not be liable for indirect or consequential damages, including but not limited to loss of enjoyment, emotional distress, lost income, or additional expenses incurred outside of the services directly provided by CRWild.

19.6 Third-Party Services
Complaints or claims arising from services provided by Third-Party Suppliers (e.g., airlines, accommodations, transport providers) must be directed to the relevant supplier, in accordance with their own terms and conditions.

20. Special Services and Herping Activities

20.1 Nature of Activities
Herping activities, wildlife observation, night expeditions, and other specialized services offered by CRWild (collectively, “Special Services”) may involve increased risks due to environmental conditions, wildlife behavior, restricted visibility, and remote locations.

20.2 Acknowledgment of Risks
By participating in Special Services, the Guest expressly acknowledges and accepts the inherent risks involved, including but not limited to:
(a) encounters with venomous or dangerous species (snakes, amphibians, reptiles, insects, mammals);
(b) environmental hazards such as uneven terrain, mud, rivers, or dense vegetation;
(c) adverse weather conditions;
(d) limited or delayed access to medical facilities.

20.3 Guest Conduct and Compliance
Guests must follow all safety instructions and behavioral guidelines provided by CRWild guides, including but not limited to:
(a) restrictions on handling or approaching wildlife;
(b) mandatory use of safety equipment (flashlights, boots, gloves, etc.);
(c) staying within designated group areas during night walks or remote explorations.

20.4 Right to Refuse Participation
CRWild reserves the right to exclude any Guest from Special Services if their behavior endangers themselves, others, wildlife, or the environment. In such cases, no refund or compensation will be provided.

20.5 Limitation of Liability
CRWild shall not be liable for injury, illness, property loss, or damages arising from participation in Special Services, except in cases of proven gross negligence by CRWild. Guests accept full responsibility for their voluntary participation.

20.6 Optional Nature
Participation in Special Services is optional and may require additional fees. Declining participation does not entitle the Guest to a refund or price reduction of the Expedition.

21. Travel Documents

21.1 Guest Responsibility
It is the sole responsibility of the Guest to obtain, maintain, and present valid travel documents necessary for participation in the Expedition, including but not limited to:
(a) passport valid for at least six (6) months after the Expedition’s completion date;
(b) entry visas, permits, or authorizations required by destination countries;
(c) vaccination certificates or other health documentation required by authorities;
(d) any other documentation required for international or domestic travel.

21.2 Accuracy of Information
The Guest is responsible for providing accurate personal information for the issuance of tickets, permits, or reservations. CRWild shall not be liable for costs, penalties, or denied services resulting from inaccurate or incomplete information provided by the Guest.

21.3 Consequences of Non-Compliance
Failure to obtain valid travel documents, or denial of entry, exit, or boarding by immigration or transport authorities, shall be deemed a cancellation by the Guest, subject to the cancellation penalties described in Section 13. No refunds or compensation shall be issued.

21.4 Advisory Role of CRWild
While CRWild may provide general information regarding passports, visas, or vaccination requirements, such information is provided as a courtesy only. Guests remain solely responsible for verifying requirements with the appropriate embassies, consulates, or authorities.

21.5 Liability Disclaimer
CRWild shall not be liable for any losses, costs, delays, or damages arising from the Guest’s failure to secure or present valid travel documents.

22. Images and Marketing

22.1 Consent to Use of Images
By participating in an Expedition, the Guest grants CRWild a perpetual, worldwide, royalty-free, and irrevocable license to use photographs, video recordings, and other images taken of the Guest during the Expedition (“Images”) for promotional, marketing, educational, or commercial purposes, in any format or media, without further obligation or compensation.

22.2 Ownership
All Images captured by CRWild staff, guides, contractors, or representatives during an Expedition shall be considered the intellectual property of CRWild.

22.3 Exclusion of Liability
CRWild shall not be held liable for use of Images by other Guests, Third-Party Suppliers, or individuals outside of CRWild’s control.

22.4 Minor Participants
In the case of Minors, consent for the use of Images must be provided by a parent or legal guardian at the time of booking. Absence of written objection will be deemed as implied consent.

22.5 Right to Withdraw
Guests may request in writing, prior to the start of the Expedition, to restrict CRWild from using their likeness in promotional material. CRWild will make reasonable efforts to comply but cannot guarantee exclusion from group footage, incidental appearances, or previously published material.

22.6 Guest-Created Content
Guests who capture and publish content (photos, videos, blogs, etc.) during the Expedition agree not to use such content for commercial purposes without prior written authorization from CRWild, particularly when such use may conflict with CRWild’s branding or commercial interests.

23. Privacy Policy

23.1 Collection of Personal Data
CRWild collects personal information from Guests necessary to provide travel services, including but not limited to:
(a) full name, date of birth, nationality, and contact information;
(b) passport details and travel documentation;
(c) payment and billing information;
(d) health and medical data relevant to participation in Expeditions.

23.2 Purpose of Processing
Personal data is collected and processed for the following purposes:
(a) booking and operational management of Expeditions;
(b) compliance with legal and immigration requirements;
(c) emergency and safety management;
(d) communication and customer service;
(e) marketing and promotional activities (subject to Section 22 on Images and Marketing).

23.3 Data Sharing
Personal data may be shared with:
(a) Third-Party Suppliers providing services related to the Expedition (accommodation, transport, meals, activities);
(b) governmental or immigration authorities when legally required;
(c) insurance providers, medical professionals, or emergency responders, in case of accidents or emergencies.

23.4 Data Retention
CRWild will retain personal data only for as long as necessary to fulfill contractual and legal obligations. Data not required for ongoing services will be securely deleted or anonymized.

23.5 Security Measures
CRWild implements reasonable technical and organizational measures to protect personal data against unauthorized access, loss, or misuse. However, CRWild does not guarantee absolute security of transmitted or stored data.

23.6 Guest Rights
In accordance with Costa Rican Law 8968, Guests have the right to:
(a) access their personal data held by CRWild;
(b) request correction, update, or deletion of their data;
(c) withdraw consent for data processing, subject to contractual and legal obligations.

Requests must be submitted in writing to CRWild.

23.7 Limitation of Liability
CRWild shall not be liable for unauthorized access or misuse of personal data by Third-Party Suppliers, provided such disclosure was necessary for the execution of contracted services or required by law.

23.8 Marketing Communications
Guests may opt out of receiving promotional emails or marketing communications by notifying CRWild in writing.

24. Severability and Amendments

24.1 Severability
If any provision of these Terms is determined by a competent court or arbitral tribunal to be invalid, illegal, or unenforceable, such provision shall be severed and the remaining Terms shall remain valid, binding, and enforceable to the fullest extent permitted by law.

24.2 No Waiver
Failure by CRWild to enforce any provision of these Terms at any given time shall not be construed as a waiver of CRWild’s right to enforce such provision at a later date.

24.3 Amendments by CRWild
CRWild reserves the right to amend, update, or modify these Terms at any time, provided that the version in effect at the time of booking shall govern that specific Contract, unless changes are required by law or governmental regulation.

24.4 No Verbal Amendments
No employee, guide, agent, or representative of CRWild is authorized to modify these Terms verbally. Any purported oral modification shall be null and void. Amendments must be made in writing and authorized by a duly appointed representative of CRWild.

24.5 Guest Amendments
Requests by the Guest for modifications or exceptions to these Terms shall only be valid if expressly accepted in writing by CRWild.

24. Severability and Amendments

24.1 Severability
If any provision of these Terms is determined by a competent court or arbitral tribunal to be invalid, illegal, or unenforceable, such provision shall be severed and the remaining Terms shall remain valid, binding, and enforceable to the fullest extent permitted by law.

24.2 No Waiver
Failure by CRWild to enforce any provision of these Terms at any given time shall not be construed as a waiver of CRWild’s right to enforce such provision at a later date.

24.3 Amendments by CRWild

25. Liability

25.1 Limitation of Liability
To the maximum extent permitted by law, CRWild’s total liability, whether arising in contract, tort, negligence, strict liability, or otherwise, shall not exceed the total amount paid by the Guest to CRWild for the specific Expedition giving rise to the claim.

25.2 Exclusion of Indirect Damages
CRWild shall not be liable for any indirect, consequential, or incidental damages, including but not limited to: loss of enjoyment, emotional distress, inconvenience, lost income, additional expenses, or loss of or damage to property.

25.3 Third-Party Services
CRWild acts solely as an intermediary for services provided by Third-Party Suppliers (including but not limited to airlines, accommodations, transportation companies, restaurants, and activity providers). CRWild shall not be liable for any acts, omissions, negligence, or defaults of Third-Party Suppliers.

25.4 Guest Assumption of Risk
The Guest acknowledges and voluntarily accepts that Expeditions involve inherent risks, including accidents, injuries, illnesses, wildlife encounters, weather events, and logistical disruptions. By booking, the Guest assumes full responsibility for all such risks.

25.5 Exclusion of Liability for Unforeseeable Events
CRWild shall not be liable for any failure or delay in performance resulting from Force Majeure or National Security events, as defined in Section 15.

25.6 Guest Responsibility for Personal Safety
Guests are solely responsible for:
(a) following all safety instructions from CRWild staff and guides;
(b) maintaining appropriate conduct during the Expedition;
(c) using required safety equipment;
(d) securing adequate insurance coverage as required under Section 11.

25.7 Medical Treatment and Evacuation
In the event of illness, injury, or accident, CRWild may, at its discretion, arrange emergency evacuation or medical treatment. All associated costs, including transportation, hospitalization, and repatriation, shall be borne exclusively by the Guest. CRWild provides no warranty regarding the adequacy of local medical facilities.

25.8 Waiver of Claims
By booking an Expedition, the Guest releases CRWild, its employees, guides, directors, shareholders, and agents from any and all liability, except in cases of proven gross negligence or willful misconduct.

26. Final Clauses

26.1 Entire Agreement
These Terms constitute the entire agreement between CRWild and the Guest. They supersede any prior agreements, understandings, representations, or communications, whether written or oral, relating to the subject matter hereof.

26.2 No Assignment
The Guest may not assign, transfer, or delegate their rights or obligations under this Agreement without CRWild’s prior written consent. Any attempted assignment without consent shall be null and void.

26.3 Governing Law and Jurisdiction
This Agreement shall be governed exclusively by the laws of the Republic of Costa Rica. Any dispute arising out of or in connection with this Agreement shall be submitted to final and binding arbitration before the Costa Rican Chamber of Commerce, seated in San José, Costa Rica.

26.4 Language Priority
This Agreement may be translated into other languages for convenience. In the event of a discrepancy between the Spanish version and any translation, the Spanish version shall prevail.

26.5 Electronic Acceptance
Electronic confirmation of a booking, payment of deposit, or acceptance via digital signature shall constitute full legal acceptance of these Terms, with the same validity as a handwritten signature.

26.6 Survival of Clauses
Any provisions relating to limitation of liability, assumption of risk, indemnification, governing law, dispute resolution, and privacy shall survive the termination or completion of the Expedition and remain in full force.

26.7 Headings
Headings in these Terms are for convenience only and shall not affect the interpretation of the Agreement.

27. Additional Clauses

27.1 Indemnification
The Guest agrees to indemnify, defend, and hold harmless CRWild, its employees, guides, agents, and affiliates from any claims, damages, liabilities, or expenses (including legal fees) arising from:
(a) the Guest’s negligence, misconduct, or breach of these Terms;
(b) actions by third parties caused directly or indirectly by the Guest’s conduct; or
(c) legal proceedings initiated against CRWild outside of Costa Rica.

 

27.2 Guest Conduct and Expulsion
Guests are required to conduct themselves respectfully toward CRWild staff, other participants, local communities, and the environment. CRWild reserves the right to refuse service or remove any Guest who engages in:
(a) harassment, abusive behavior, or offensive language;
(b) illegal activities, including the use or possession of drugs;
(c) excessive consumption of alcohol impairing safety;
(d) reckless, disruptive, or unsafe conduct.
No refund or compensation shall be provided in such cases, and the Guest shall remain liable for all related costs.

 

27.3 Alcohol and Substance Use
Consumption of illegal drugs is strictly prohibited during all Expeditions. Alcohol consumption may be permitted in moderation but is strictly prohibited before or during activities requiring physical effort or safety precautions (e.g., herping walks, rafting, hiking). CRWild shall not be liable for accidents or incidents arising from violation of this clause.

 

27.4 Personal Belongings and Baggage
Guests are solely responsible for their baggage and personal belongings at all times. CRWild is not liable for loss, theft, or damage of personal property, except where directly caused by gross negligence of CRWild staff.

 

27.5 Scientific Records, Images, and Data (Herping Expeditions)
Any scientific observations, photographs, audio, or video recordings made during herping or wildlife expeditions remain the intellectual property of CRWild, unless otherwise agreed in writing. Guests shall not use such material for commercial or scientific publication without CRWild’s prior written consent.

 

27.6 Health and Vaccination Requirements
CRWild reserves the right to require proof of vaccinations, medical clearances, or preventive treatments (e.g., yellow fever, malaria prophylaxis) for certain destinations. Guests who fail to comply may be refused participation without refund.

 

27.7 Confidentiality of Custom Itineraries
For private, tailor-made, or research expeditions, Guests agree to maintain confidentiality regarding routes, locations, species data, and proprietary methodologies provided by CRWild. Unauthorized disclosure may result in legal action.

 

27.8 Jurisdiction Exclusivity
All disputes must be brought exclusively before arbitration in Costa Rica. If a Guest initiates legal action in a foreign jurisdiction, the Guest shall reimburse CRWild for all legal fees, costs, and expenses incurred in defending such proceedings.

 

27.9 Acknowledgement of Natural Risks
The Guest acknowledges that wildlife sightings, favorable weather, and environmental conditions cannot be guaranteed. Variations in wildlife activity or weather disruptions do not constitute grounds for refund, claim, or compensation.

 

27.10 Adventure Activity Waiver
For activities of higher risk (including but not limited to rafting, rappelling, canopy, snorkeling, scuba diving, and herping night walks), Guests must sign an additional waiver of liability prior to participation. Failure to sign the waiver may result in exclusion from the activity without refund.
