Deposit Policies, Terms and Conditions.

Booking Agreement

By booking or participating in a CRWild Journey and any related products or services (hereinafter referred to as a "CR Expedition"), operated by CRWILD. ("CR Adventures"), you ("you" or "the Guest") agree to the following Terms & Conditions (the "Terms").

Introduction

CRWild: CRWild Partners,  (hereinafter referred to as "CRW") will provide educational enrichment experiences as outlined in its catalog and on its website www.crwild.com. CRW has licensed CRW Adventures to organize and administer CRWild Expeditions. CRW is solely responsible for arranging and providing all the services and accommodations offered to you in connection with the expedition.

By booking an Expedition, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you make a booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of the other participants in your party.

The Booking Contract

Your booking is confirmed, and a contract is deemed to exist when CRW or your travel agent (CRW) issues a written confirmation after receipt of the applicable deposit amount. Please carefully review your confirmation and promptly report any incorrect or incomplete information to CRW or authorized agent. Ensure that the names provided are an exact match to those stated in the relevant passport.

To make a booking, you must be at least 18 years of age. By booking, you agree to provide CRW with full, complete, and accurate information.

Booking on Behalf of Others

If you are booking on behalf of other participants, you are considered the designated contact person for every participant included in that booking. As such, you are responsible for the following:

Making all payments due in connection with your Expedition booking.

Notifying CRW or your travel agent promptly if any changes or cancellations are required.

Keeping all members of your party informed regarding the booking details.

By booking on behalf of another person or persons, you represent and warrant that you have obtained all necessary consents. You are responsible for ensuring that any information you provide on behalf of another participant is complete and accurate. CRW will not be liable for any errors or omissions in the information provided during the booking process.

Representation of Health/Safety/Right to Terminate:
By booking your Trip, you represent and certify that you and all members of your traveling party: (i) have carefully read the details of the itinerary and selected an itinerary that is appropriate for each person’s abilities; (ii) do not have any impairment or disability which might present a safety risk during the Trip or any of the Activities; (iii) have consulted with a personal physician as appropriate; and (iv) will immediately advise us if anyone in your travel party is unable to meet the safety requirements that are necessary for the safe operation of the Trip or Activity. If your circumstances change between the date of booking and the Trip departure, you must inform us as soon as possible and advise us of any special requests.

We reserve the right to cancel, terminate, discontinue or modify any reservation, Trip, or Activity, if the Guest cannot meet the safety requirements that are necessary for safe operation or fails to obey signage, instructions, protocols, or rules. We further reserve the right to: (i) immediately terminate any Trip or Activity if the Guest is disruptive or otherwise adversely impacts the experience for others, without any refund to the Guest; and (ii) make changes to the itinerary or Activity as appropriate for safety, security, comfort or convenience, without liability or notice.

Required Medical Information

You are required to provide any medical information reasonably requested by CRW and may be asked to complete the CRW’s medical information form (the "Medical Form"), which can be found on CRW's website at www.crwild.com or by contacting info@crwild.com.

Medical Forms are obligatory for specific Expeditions. If you have any pre-existing medical conditions that could affect your ability to travel, participate in an expedition, or travel to remote areas without access to medical facilities, or that may have an adverse impact on the experience of other participants, you must submit a Medical Form. This form should be signed by a licensed and practicing physician and returned to CRW either prior to or at the time of final payment for your booking.

You agree to complete the Medical Form honestly and provide all relevant medical information accurately and comprehensively. CRW will handle this information in accordance with its Privacy Policy.

CRW retains the right to request further information or seek professional medical opinions, at its discretion, for the purpose of ensuring your safety or the safe operation of a Expedition.

CRW reserves the right to deny you to travel or participate in any aspect of an Expedition if, at any time, it determines that your physical or mental condition makes you unfit for travel or represents a danger to yourself or others.

Pregnancy is considered a medical condition and must be disclosed to CRW at the time of booking. CRW may decline to carry pregnant women who are over 24 weeks into their pregnancy. Additionally, CRW may refuse to accommodate individuals with certain medical conditions if reasonable alternatives or accommodations cannot be arranged.

Failure to complete the required Medical Form or provide necessary medical information to CRW by the indicated deadline may result in CRW canceling your booking, and applicable cancellation fees will be applied.

It is your responsibility to assess whether an expedition is suitable for you. We recommend consulting your physician to confirm your fitness for travel and participation in planned activities. Your physician's advice on vaccinations and medical precautions should be sought. Please note that CRW does not provide medical advice. You are responsible for evaluating the risks and requirements of each aspect of the Expedition based on your unique circumstances, limitations, fitness level, and medical needs.

Traveling with CRW may involve visiting remote or developing regions where access to medical care may be limited, and medical facilities may not meet the standards of your home country. The quality of medical facilities in the countries you visit during your journey can vary, and CRW makes no representations or warranties concerning the availability or standard of medical facilities in these regions.

Pregnancy:
For any cruise Trip, women who have entered their 24th week of pregnancy as of the Trip start date or who will enter their 24th week of pregnancy during the Trip will not be permitted to book the Trip. For all other Trips, airlines and local Suppliers, may have additional restrictions applicable to women who are pregnant, and depending on the week of pregnancy, pregnant women may not be permitted to book or participate in certain Activities. For these select itineraries, neither a physician’s medical statement nor a waiver of liability will be accepted by us. We cannot be held responsible or liable for any complications relating to pregnancy at any stage. If pregnant, you are strongly encouraged to consult with your personal physician before booking a Trip regardless of itinerary. Please contact us if you have questions about specific itineraries.

Special Requirements

Any special requirements must be disclosed to CRW at the time of booking. CRW will make reasonable efforts to accommodate special requirements or requests, but please understand that it may not always be possible due to the nature of the destinations visited and the availability of options outside of the planned itinerary. Please note that certain activities may be inaccessible if you have limited mobility. Additionally, all food allergies and dietary restrictions must be disclosed to CRW prior to the time of booking. While we will make every effort to accommodate dietary needs and restrictions, we cannot guarantee that all requests can be fulfilled. Please be aware that any special requests or requirements do not form part of these Terms or the contract between you and CRW. CRW is not liable for any failure to accommodate or fulfill such requests.

Allergies and Special Dietary Requests:
On the Trip, meals are prepared based on the availability of ingredients in each destination. Please keep in mind specific meal requests may not be available at every stop. Further, please be advised that food and beverage locations are not owned or operated by us. For food and beverage offerings arranged by us, we use reasonable efforts to communicate special dietary requests to the locations and, for pre-packaged retail food and beverage, we rely on supplier/manufacturer ingredient labels. Please contact us so you can make an informed choice because food preparation processes and menus vary by location. You are responsible for deciding whether any particular offering meets your requirements. We cannot guarantee that any offering is completely free of allergens.

Trip Activity Level and Requirements:
You are advised to carefully read the details of your selected itinerary before booking a Trip. Certain itineraries may not be suitable for all Guests, including Guests with disabilities, due to terrain/local conditions, the nature of the Activities, or otherwise. Neither our staff nor our Suppliers/contractors may physically assist Guests who need or may need assistance during the Trip or with respect to any Activity. All Guests are strongly encouraged to consult with their personal physician before booking a reservation. In addition, select itineraries may require Guests to obtain prior written approval from their personal physician. Please contact us about specific itineraries or Activities. Note: with regard to expedition and river cruises, please contact us regarding availability of embarkation and disembarkation assistance by Trip.

Service Providers/Suppliers:
We may license or engage qualified professional tour operators to organize and administer activities or travel. Any such designated tour operator, its parent, subsidiaries, and assigns, and their respective employees, affiliates, officers, directors, successors, representatives, agents and assigns (collectively “Tour Operator”), in turn, acts only as an agent for any transportation carrier, hotel, ground operator, restaurants, or other suppliers of services connected with specific itineraries (“Suppliers”). The Suppliers are solely responsible and liable for providing their respective services and neither we nor Tour Operators are responsible for delay, mishap, inconvenience, expense, irregularity, bodily injury, illness, emotional distress, death, or loss to property occasioned by or through the conduct or omission of a Supplier, each of which is subject to the laws of the country or state where the services are provided. In addition, the passenger tickets in use by any carriers will constitute the sole contract between you and the carrier; the carriers are not responsible for any act, omission, or event during the time you are not aboard their conveyances.

Independent Activities:
If you decide to participate in any activity or excursion that is not arranged or led by us or the Tour Operator, neither we nor the Tour Operator shall have any responsibility for or control over your safety or well-being, which will be solely your responsibility.

Age Requirements

Anyone under the age of 18 on the date of the first travel is considered a minor. Minors must always be accompanied by at least one adult in charge (parent or legal representative). One adult may accompany up to two minors. Unless otherwise specified in the Expedition description or by CRW, the minimum age for minors traveling on any Expedition is 12 years old.

All bookings involving a minor are subject to review and approval by CRW. If the consent of a parent, guardian, or any other person is required by applicable law for a minor to travel, the accompanying adult is responsible for securing all necessary consents, documentation, and ensuring that they and the minor(s) meet all legal requirements for travel, entry into, and departure from applicable countries and regions. CRW will not be responsible for any fees, damages, or losses incurred due to a failure to secure the required consents, permits, and approvals.

Each adult included in a booking with a minor or minor(s) is jointly and severally responsible for the behavior, well-being, supervision, and monitoring of such minor(s). They also jointly and severally accept these Terms on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. Please note that CRW does not provide care services for minors and explicitly disclaims any responsibility for chaperoning or controlling any minor(s).

Mandatory Insurance Requirements

You are required to have travel insurance with a minimum coverage of US$200,000 for medical, evacuation, and repatriation expenses, which must cover all applicable travel dates with CRW. This insurance must include coverage for personal injury and emergency medical expenses. On the first day of each Expedition, an Expedition Operator representative will verify that you have adequate insurance in place. We strongly recommend extending your coverage to include cancellation, curtailment, and all other potential expenses that may arise due to loss, damage, injury, delay, or inconvenience during travel. Please be aware that insurance coverage is not included in the cost of any Expedition offered by CRW, and you are required to obtain separate coverage at an additional cost. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are also responsible for informing your insurer about the type of travel, destination(s), and activities included in your booking to ensure appropriate coverage.

Prices, Surcharges, and Taxes

The published price of the Expedition and any products or services offered by CRW is subject to change at any time, both before and after booking confirmation, up to 30 days before departure. Expedition prices are listed and advertised exclusive of applicable sales taxes. After a confirmation invoice has been issued by CRW, CRW reserves the right to impose surcharges on any products or services booked for reasons related to increases in transportation costs, fuel costs, dues, taxes, or fees associated with services such as landing taxes or embarkation or disembarkation fees at ports and airport charges, local operator costs, currency and exchange rate fluctuations, increases in taxes, or government actions affecting the price of the applicable products or services. However, CRW will only impose such surcharges when the increase exceeds 2% of the original price paid for the products or services (excluding add-ons, insurance, and taxes). Upon identifying the need to impose a surcharge as described in this section, CRW will provide notice to you as soon as reasonably possible.

If the price increase exceeds 13% of the original price of the applicable products or services (excluding add-ons, insurance, and taxes), you may choose one of the following options:

(a) Cancel the applicable booking without incurring any penalty.

(b) Accept the change of price.

You must inform CRW of your choice within 14 days of receiving notice of the price increase, or you will be considered to have accepted the price change and will be responsible for paying the increase.

Occasionally, CRW may offer reduced pricing for specific products or services. Reduced pricing applies only to new bookings. Bookings for which CRW has received at least a deposit are not eligible for reduced pricing.

VALIDITY

All dates, itineraries, and prices of Expeditions are subject to change at any time. The current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be applied in accordance with these Terms. You acknowledge your responsibility to stay updated on the specific details of your Expedition and any other products or services. This includes checking CRW's website at least 72 hours before departure, as minor changes may have been made after your initial booking.

DEPOSITS

At the time of booking, a non-refundable deposit of USD$600 (or another deposit amount for tailor-made clients, as applicable) per person per Expedition is required by CRW. If the booking is made 90 days or less before departure, full payment is due at the time of booking. You should send the non-refundable deposit to CRW or its authorized agent, as applicable.

In some cases, when certain products or services offered by CRW are combined, a higher deposit or full payment may be required at the time of booking. CRW will inform you of any such requirements before confirming the booking.

Lifetime Deposits: If you cancel your booking, and the cancellation is not a result of non-payment or any other breach of these Terms, the deposit amount will be held as a "Lifetime Deposit" with CRW, subject to these Terms. Lifetime Deposits have no expiration date and can be applied toward the deposit of any other Expedition offered by CRW. They are transferable and can be transferred to another individual of your choosing by notifying CRW in writing.

For clarity, only the deposit amount will be considered part of the Lifetime Deposit, and it has no cash value. You can apply only one Lifetime Deposit per person per product booked. A Lifetime Deposit must be used for a new Expedition booking that is of equal or greater value than the canceled Expedition for which the Lifetime Deposit was originally received. A Lifetime Deposit cannot be applied to the same or similar travel dates.

Errors in Local and International Transfers

CR Wild will not be responsible for any fees or charges arising from errors made by the client when conducting international transfers. It is the client's responsibility to ensure all details of the transfer. When using International Transfer to pay a deposit or expedition, please be sure that all fields required by the receiving bank are filled and correct. Understand that the rejection of your transfer will result in significant deductions that can only be recovered if your account has the proper insurance. CRWild does not assume losses due to incorrect transfers or incompetence.

DETAILS REQUIRED FOR BOOKING

As a condition of booking, you must provide the information requested by CRW along with the final payment. Failure to provide all required information before the due date for full payment may result in an administrative fee being charged by CRW to cover any costs incurred due to your failure to provide the required information. If you fail to supply information needed by CRW for air tickets, permits, or other inclusions, you will also be responsible for any associated costs, fees, or losses, including failure to obtain or provide the specified inclusion.

If you fail to provide the required information, CRW reserves the right to treat your booking (or the relevant component of your booking) as canceled and may levy reasonable cancellation fees at its sole discretion. The specific information required by CRW will vary depending on the Expedition and will be communicated to you or CRW's authorized agent during the booking process. CRW will not be held responsible for any fees you incur due to errors, omissions, inaccuracies, late submissions, misplaced information, or other incomplete details you have provided.

AIRFARE

Expedition prices do not include international or other airfare unless expressly mentioned in the Expedition's descriptions. CRW will provide a quote for the best available price for the requested travel dates when the quote is prepared. These quotes are estimates only and do not constitute a firm commitment to the price by CRW or the relevant air carrier(s).

CRW acts solely as a sales agent for the applicable air carrier, and the terms and conditions of the air carrier apply to the purchase and use of air travel tickets. Please refer to the air carrier's terms and conditions, as well as their conditions of carriage, for comprehensive information, including applicable cancellation terms. CRW is not responsible for changes in air itineraries or flight times and does not offer advice or notifications regarding air travel tickets, flight status, or delays.

FINAL PAYMENT & ACCEPTANCE OF BOOKING

The confirmation sent by CRW or your travel agent will include details about the final payment required for your booking. Payment of the balance of the price for any products or services, including custom-tailored ones, is due 60 days before the departure date of the first product or service included in the booking. If full payment is not received by the specified due date, CRW may, at its sole discretion, adjust the rate payable for the booking or consider the booking as canceled, retaining the deposit paid on booking as a cancellation fee. In the event that a booking is made less than 60 days before the departure date of the first product included in the booking, the full amount must be paid at the time of booking. If payment terms for any product or service vary from those outlined in this section, the applicable terms will be communicated to you before booking and will also be detailed on the relevant invoice.

Please note that CRW is not responsible for any charges imposed by third parties or financial institutions and payable by you due to credit card or other payment transactions. CRW will not refund or reimburse any fees charged by third parties or financial institutions related to payments made by you to CRW.

Pre- and Post-Trip Extensions and Extra Arrangements:
We recommend that you arrive a day or two prior to the start of your Trip to get acclimated and to allow for unexpected travel delays. Also, you may choose to stay a day or two after to extend your Trip on your own. Both pre- and post-stays are available at additional cost to you. Please contact us for price, details and availability, which are not guaranteed. On some Trips, airport meet & greet and hotel transfer services are available in connection with these additional days. Our special rates for these additional days are only available if booked through us in conjunction with a Trip and cannot be combined with any other offer. Canadian Guests please contact your travel agent.

Air Travel:
Neither we, the Tour Operator, Suppliers, nor any of their affiliates, will be liable for any air carrier's cancelation penalty incurred by the purchase of a nonrefundable ticket to or from the Guest’s Trip departure city or return city. Any airline tickets issued are subject to the carrier’s refund policy. Baggage and personal effects are at all times the sole responsibility of the Guest.

CANCELLATION BY THE PARTICIPANT

You may cancel your booking by notifying CRW. Cancellation fees, if applicable, will be determined based on the date when the notice of cancellation is received by CRW. These fees are expressed as a percentage of the total price paid for the canceled Expedition, product, or service (excluding any insurance products).

Cancellation of an Expedition:

(a) Cancellation received 90 days or more before the departure of the first product or service in the relevant booking: The Lifetime Deposit will be held by CRW in accordance with these Terms, and the remainder of the payments made to CRW for the canceled product will be refunded.

(b) Cancellation received 60 days before the departure of the first product or service in the relevant booking: The Lifetime Deposit will be held by CRW in accordance with these Terms, and an amount equal to 50% of the remainder of the payments made to CRW for the canceled Expedition will be refunded.

(c) Cancellation less than 60 days before the departure of the first product or service in the relevant booking: The Lifetime Deposit will be held by CRW in accordance with these Terms, and no further refund will be payable.

In the event that certain products or services offered by CRW are combined, alternative cancellation terms may apply. CRW will inform you of any such requirements before confirming the applicable booking.

Cancellation of Arrival Transfers, Pre and Post Night Accommodations, My Own Room, and optional activities booked directly with CRW:

(a) Cancellation 90 days or more before departure: You will receive a full refund for canceled Arrival Transfers, Pre and Post Night Accommodations, My Own Room, and optional activities.

 

(b) Cancellation 90 days or less before departure: No refund will be payable for any canceled Arrival Transfers, Pre and Post Night Accommodations, My Own Room, and optional activities.

 

GUARANTEED DEPARTURES & CANCELLATION OF AN EXPEDITION BY CRW

A departure date for an Expedition offered by CRW will become guaranteed when at least one booking secured by a valid deposit has been made for that departure.

CRW guarantees that all scheduled Expedition departures booked and secured with a valid deposit will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure. Up-to-date Expedition and itinerary information is available on CRW's website or by contacting CRW. Brochures and other printed materials displaying Expedition information and departure dates are subject to change and may not be relied upon for the purposes of this guarantee.

If an Expedition is canceled by CRW before the date of departure for reasons other than Force Majeure, and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from CRW:

 

(a) a substitute Expedition of equivalent value; or (b) a substitute Expedition of lesser value if no Expedition of equivalent value is reasonably available and to recover from CRW the difference in price between the price of the Expedition originally purchased and the substitute Expedition; or (c) a full refund of all monies paid for the canceled Expedition.

CRW is not responsible for any incidental expenses or consequential losses you incur as a result of the canceled booking, including visas, vaccinations, non-refundable flights or rail tickets, non-refundable car parking, or other fees, loss of earnings, or loss of enjoyment. CRW reserves the right to issue a full refund at its sole discretion instead of the choices above. If a significant element of a Expedition as described cannot be provided after departure, CRW will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, CRW may provide you with a refund for unused products or services as determined at its discretion.

Itinerary Modifications/Our Right to Cancel:

We will make every reasonable effort to operate the Trips as advertised; however, we and Tour Operator reserve the right to curtail or modify the itinerary, including but not limited to curtailment or modification of Activities, hotels, meals, transportation, and Experts, as we deem necessary. Please also note that during certain holidays and peak periods or due to repairs or renovations, some Activities may be disrupted or unavailable. Deviations from planned Trip itineraries or any aspects of the travel may occur. If conditions make river cruise routes unsafe for navigation or in other respects, or raise sufficient doubt about safety, we and Tour Operator reserve the right to modify or provide alternate services, which may include, but are not limited to, providing accommodation on the docked ship or on land and/or substituting ground arrangements for river cruise transportation. We and Tour Operator further reserve the right to reduce the number of Experts, and to modify other services to accommodate a smaller group, if a minimum number of guests is not reached. Similarly, the stated group maximum size may be marginally exceeded if necessary to accommodate a family. None of these modifications or changes shall affect the Trip price or entitle you to any credit or refund,

We shall also have the right, in our sole and absolute discretion to cancel or modify a reservation in whole or in part, at any time if the reservation includes or was made as the result of a mistake or error of any kind, including, but not limited to, a mistake or error in price or description of the Trip or Activity, or where it appears that a Guest has engaged in fraudulent or misleading activity in making the reservation, or due to prior disputed or suspected fraudulent payment transactions. If a reservation is canceled by us, in cases where we have received a valid and confirmed payment, we will provide a refund, and shall have no responsibility beyond the refund of monies paid to us related to the cancelation by us.

We reserve the right to cancel any Trip or Activity because of inadequate enrollment that makes the Trip or Activity economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the Guests. If we cancel a Trip prior to departure, the Guest will be provided with a full refund of monies paid to us; except in the event that the cancelation is due to a significant event that makes it infeasible to operate the Trip as planned, in which case the Guest will be provided with a refund and/or credit toward a future Trip equivalent to the amount paid.

If a Guest elects to leave a Trip in progress of their own volition, the Guest will not receive any type of refund. If we or the Tour Operator cancels the Trip in progress and the Guest elects not to immediately return to his/her original point of departure for the Trip, or if the Guest elects to leave a Trip in progress of their own volition, the Guest acknowledges and agrees that: (i) the Guest shall be solely responsible for Guest’s travel plans once Guest departs the Trip; (ii) neither we nor the Tour Operator shall have any responsibility for or control over the Guest’s safety or activities once the Guest departs the Trip; and (iii) the Guest will be solely responsible for any and all costs that may arise out of the Guest’s decision to not return to the original point of departure from the Trip in progress. Except as outlined above when we cancel a Trip, you will have full responsibility for any expenses, including any non-refundable expenses, incurred by you in preparing for a canceled Trip or for any additional arrangements should you embark prior to the scheduled group departure date.

National Security Cancellation Clause:

Cancellation for National Security Reasons: 1.1 In exceptional cases and for national security reasons, CRWILD reserves the right to cancel a confirmed expedition, even if the client has made full payment for the service. 1.2 This cancellation may be necessary due to situations posing a significant risk to the safety of expedition participants, including, but not limited to, political conflicts, civil unrest, criminal activity, terrorist threats, or any other event deemed a threat to security by local or international authorities.

Definition of "National Security Reasons": "National Security Reasons" is understood to encompass any situation that could jeopardize the integrity and safety of participants, including but not limited to armed conflicts, civil disturbances, terrorist threats, natural disasters, epidemics, or any other situation deemed a threat to security by competent authorities.

Cancellation Procedures: 2.1 In the event that the Company is compelled to cancel an expedition for national security reasons, reasonable efforts will be made to notify the client as soon as possible after the decision is known. 2.2 The Company commits to offering a substitute expedition in a secure location and in accordance with the client's preferences, subject to availability and cost adjustments, if any, on a date agreed upon with the clients. 2.3 The total or partial amount paid by the client for the canceled expedition will be frozen and can be used to schedule a future expedition at a safe and convenient time for both parties, following the Company's established procedures.

Security Guarantees in Substitute Expeditions: 2.4 In the case of providing a substitute expedition, the Company will ensure the implementation of additional security measures to safeguard the integrity of participants.

Limitation of Liability: 3.1 The Company shall not be liable for consequential losses or damages that may arise as a result of the cancellation of an expedition for national security reasons. 3.2 Clients understand and accept that the safety of participants is the highest priority in these circumstances and waive any claims or demands against the Company for the cancellation due to national security reasons.

Force Majeure:
Neither we nor our corporate parent, subsidiaries, affiliates, assigns, employees, officers, directors, successors, representatives, agents, or independent suppliers, will be held liable for any loss or damage due to delay, cancelation, or disruption in any manner caused by any of the following causes, to the extent beyond our reasonable control: acts of God, accidents, riots, wars, hostilities, blockages, revolutions, riots, insurrections, terrorist acts, epidemics or pandemics (including but not limited to COVID-19), quarantines, civil commotions, breakdown of communication facilities, natural catastrophes, governmental acts or omissions, changes in laws or regulations, labor strikes, fire, explosions, or sabotage.

Governmental Advisories/Necessary Travel Documents:
You are solely responsible for obtaining and understanding current travel advisories, warnings, requirements, and restrictions by contacting your travel agent, applicable embassies and consulates. We strongly encourage you to visit the U.S. State Department’s website at travel.state.gov and the U.S. Centers for Disease Control and Prevention website at cdc.gov. Non-U.S. residents should consult the appropriate consulates regarding passport, visa, and other document requirements. All Guests must have valid government-issued proof of citizenship to travel, in addition to any other requirements of the country of origin and countries visited. Those without proper documentation may be denied travel. In addition, you may be denied entry to the countries visited if you do not meet the country’s entry requirements. If you did not purchase air travel through us, you are solely responsible for notifying us of flight changes affecting your arrival or we will not be able to meet you at the specified arrival airport. Failure to obtain documents does not negate the Travel Agreement, and any extra costs incurred for rerouting due to travel without the necessary documents will be your responsibility.

You are solely responsible for obtaining any documents required for your participation on the Trip such as a valid passport, all visas, vaccination certificates, and any other documents which may be required by your itinerary or as required for traveling with minors, and complying with any destination specific requirements or restrictions.

Name Changes/Transferability:
Reservations and Trip components are non-transferable. We will make a reasonable effort to accommodate changes to Guest names prior to departure provided that at least one member of the originally-booked party travels; however, we reserve the right to pass on to you any third-party costs (such as from airlines or Suppliers (as defined herein)) we incur in so doing.

TRAVEL DOCUMENTS

It is your responsibility to obtain all the necessary documentation and identification required for entry, departure, and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities, such as visas, permits, certificates (including vaccination or medical certificates), and insurance policies. Your passport must remain valid for at least 6 months after the last date of travel with CRW, as indicated on your itinerary.

You accept full responsibility for obtaining all required documents, visas, and permits before the start of the Expedition, and you are solely responsible for covering all costs incurred due to missing or defective documentation. You agree that you will be responsible for the full amount of any loss or expense incurred by CRW as a direct result of your failure to obtain or possess proper travel documentation. CRW does not provide advice on travel documents and makes no representations or warranties regarding the accuracy or completeness of any information provided on visas, vaccinations, climate, clothing, baggage, or special equipment. You agree that CRW is not responsible for any errors or omissions in this information.

FLEXIBILITY & UNUSED SERVICES

You acknowledge that the nature of adventure travel necessitates flexibility and that you will allow reasonable alterations to products, services, or itineraries by CRW. The route, schedules, accommodations, activities, amenities, and mode of transportation are subject to change without notice due to unforeseeable circumstances or events beyond the control of CRW. These events may include, but are not limited to, Force Majeure, illness, mechanical breakdowns, flight cancellations, strikes, political events, and entry or border difficulties.

No reimbursements, discounts, or refunds will be issued for services that are missed or unused after departure due to reasons beyond the control of CRW. This includes situations where you are removed from an Expedition due to your negligence or breach of these Terms.

CHANGES

Changes made by CRWild

CRWild may modify your itinerary where reasonably required, at its sole discretion. If CRWild makes a change affecting at least one-third of the full days of the itinerary or materially affecting the character of a product or service in its entirety (referred to as a "Material Change"), CRWild will provide notice to you as soon as reasonably possible, provided there is sufficient time to do so before departure. If a Material Change is made more than 14 days before departure, you have the following options: i) Accept the Material Change and proceed with the amended product or service. ii) Book another product or service of equal or greater value, if available (you will be responsible for paying any difference in price). iii) Book another product or service of lesser value, if available (with a refund payable to you for the difference in price). iv). Cancel the amended product or service and receive a full refund for the land-only portion of the applicable product or service (a refund is not available for other products or services booked that are not subject to a Material Change).

You must notify CRW of your choice within 7 days of receiving notice, or you will be deemed to accept the amended itinerary.

Once an Expedition has departed, itinerary changes may be necessary due to unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment, or comfort. Any changes are at the discretion of CRWild. You acknowledge that you must have reasonable financial resources to cover incidental expenses during all travel with CRWild, whether or not such expenses arise from a change of itinerary. CRWild is not liable for your failure to adequately prepare for travel and unforeseen circumstances that may arise during travel. CRWild will not be liable for any indirect or consequential losses associated with changes to a booking or itinerary.

Changes made by you

You are responsible for ensuring that the information provided to CRWild is accurate and up-to-date. Any changes to your name on any booking are subject to CRW's approval. Changes to a booking depend on availability and are subject to CRW's approval and these Terms. Any additional costs incurred for making the change will be charged to you, along with an administrative fee. Cancellation of any Expedition, product, or service included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms. No changes are permitted to any booking within 60 days of the departure of the first product or service on the applicable booking.

ACCEPTANCE OF RISK

You acknowledge that adventure travel and the products and services offered by CRWild may entail a significant amount of risk to your health and safety. By traveling with CRWild, you acknowledge that you have carefully considered potential risks to health and safety. You hereby assume responsibility for all such risks and release CRW from all claims and causes of action arising from any losses, damages, injuries, or death resulting from risks inherent in travel. This includes adventure travel, visiting foreign destinations, and participating in adventurous activities outlined in Expedition itineraries or otherwise offered by CRWild.

You recognize that the extent and nature of personal risk involved may vary based on the products or services booked and the location(s) where a product or service operates. There could be a significant degree of personal risk involved in participating in physical activities, traveling to remote locations, using watercraft, engaging in "extreme sports," or visiting countries with developing infrastructure. Hygiene standards, accommodations, and transportation in certain countries where Expeditions take place may be lower than what you expect in your home country or region.

You agree that CRWild is not responsible for providing information or guidance concerning local customs, weather conditions, specific safety concerns, physical challenges, or laws applicable in any location where an Expedition, product, or service is conducted. You confirm that you have evaluated potential risks, dangers, challenges, and your own personal capabilities and needs. You expressly assume the risks associated with travel under such conditions.

Throughout your travel, you must strictly adhere to all relevant laws and regulations of all countries and regions. Failure to comply with these laws or committing illegal acts while on Expedition, or if, in CRW's reasonable opinion, your behavior endangers others, causes distress, or constitutes a material annoyance; CRW may terminate your travel arrangements immediately at your expense. In such cases, you will not be entitled to any refund for unused or missed services or expenses incurred due to the termination of your travel arrangements, including return travel, accommodations, meals, and incidentals.

You are financially responsible for any costs, including repair, replacement, and cleaning fees, resulting from property damage, destruction, or theft caused by you during your Expedition. You agree to report any pre-existing damage to a representative of CRW and the relevant accommodation, transportation service, or facility as soon as you discover it.

You agree to take all prudent measures for your own safety during the Expedition, including proper use of safety devices (such as seatbelts, harnesses, flotation devices, and helmets) and compliance with posted signs and oral or written safety instructions. Neither CRW nor its Third Party Suppliers (as defined herein) are liable for losses or damages arising from your failure to adhere to safety instructions or warnings.

To address complaints effectively, you agree to promptly bring any concerns to the attention of CRW. Notify your Expedition leader, another representative of CRW, or CRW's customer service department directly. Complaints not properly reported during the Expedition cannot be resolved afterward. Any complaints made after completing an Expedition must be submitted in writing to CRW within 30 days of the last day of travel for the booking in question.

CRWild IS NOT LIABLE FOR THIRD PARTY SUPPLIERS

CRWild arranges accommodations, activities, flights, cruises, coach services, transfers, shore excursions, local guides, and other services through independent parties known as "Third Party Suppliers" to provide various components of your booking. Third Party Suppliers may, in turn, engage local operators and subcontractors. While CRWild takes reasonable care in selecting Third Party Suppliers, it does not directly supervise or control them and cannot be held responsible for their actions or omissions.

Any services provided by Third Party Suppliers are subject to the terms and conditions set by these entities, and their liability is governed by their respective tariffs, conditions of carriage, tickets, vouchers, and international conventions and agreements that regulate their services. These terms may limit or exclude the liability of Third Party Suppliers. It is important to note that Third Party Suppliers operate in compliance with the laws of the countries where they provide services, and CRW does not guarantee their compliance with the laws of your country of residence or any other jurisdiction.

CRWild WILL NOT ASSUME RESPONSIBILITY FOR CLAIMS, LOSSES, DAMAGES, COSTS, OR EXPENSES ARISING FROM INCONVENIENCE, LOSS OF ENJOYMENT, UPSET, DISAPPOINTMENT, DISTRESS, OR FRUSTRATION, WHETHER PHYSICAL OR MENTAL, RESULTING FROM ACTIONS OR OMISSIONS OF PARTIES OTHER THAN CRW AND ITS EMPLOYEES.

CRWild does not accept liability for the actions or negligence, whether intentional or accidental, of Third Party Suppliers or any independent contractors.

FORCE MAJEURE

CRW shall not be held liable for any death, bodily injury, illness, damage, delay, or other loss or harm to individuals or property, or for any direct or indirect financial costs incurred, or for any failure by CRW to initiate, perform, or complete any obligations owed to you in the following circumstances:

  • War or war-like operations

  • Mechanical breakdowns

  • Terrorist activities or threats thereof

  • Civil commotions

  • Labor difficulties

  • Interference by authorities

  • Political disturbances

  • Riot or insurrection

  • Government restraint

  • Fire

  • Extreme weather conditions

  • Any other causes or events, wherever and however they may occur, that are beyond the reasonable control of CRWild.

This broad category of events, individually and collectively, is referred to as "Force Majeure."

In cases where any of the above-mentioned events or circumstances lead to death, delay, bodily injury (including emotional distress or injury), illness, damage, or any other loss or harm to individuals or property, you acknowledge that neither CRWild nor its Third Party Suppliers could have reasonably foreseen or prevented them.

CRWild disclaims any and all liability arising from Force Majeure events, and you agree not to hold CRWild responsible for any consequences resulting from such events.

This section outlines the situations in which CRWild cannot be held liable for certain events or outcomes beyond its control. It emphasizes that Force Majeure events are unpredictable and can impact various aspects of your travel experience. IMAGES AND MARKETING

You agree that, while participating in any Expedition, images, photos, or videos may be taken by other participants, CRW, or its representatives that may contain or feature you. You consent to any such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to CRW, its contractors, sub-contractors, and assigns, to reproduce them for any purpose whatsoever. This includes marketing, promotions, and the creation of promotional materials by or with sub-licensees, in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.

PRIVACY POLICY

CRWild must collect your personal information to deliver the Expedition and any products or services booked. CRWild collects, uses, and discloses only the information reasonably required to enable CRWild and its Third Party Suppliers to provide the particular Expedition, products, and/or services that you have requested. This is described in detail in CRW’s Privacy Policy, which can be accessed at any time at CRWILD.COM. The Privacy Policy is expressly incorporated into these Terms. By submitting any personal information to CRW, you indicate your acceptance of CRW’s Privacy Policy.

SEVERABILITY

If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only as broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.

CONTRACT PARTIES & SUCCESSORS

These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, estate trustees, successors, and assigns.

AMENDMENTS

CRW reserves the right to update or alter these Terms at any time and will post the amended Terms on CRW’s website at CRWILD.COM. Any amendment will take effect 10 days after being posted to CRW’s website. An up-to-date copy of these Terms, as amended, may be accessed at any time on CRW’s website and will be sent to you upon written request to CRW. You are deemed to have accepted any amendments to these Terms on the date that is 10 days after their posting on CRW’s website. CRW recommends that you refer to the Terms prior to travel to familiarize yourself with the most up-to-date version available.

ADDITIONAL TERMS

By booking or traveling on an Expedition, you certify that you do not have any mental, physical, or other condition that would create a hazard for yourself or other participants. CR and CRW reserve the right in their sole discretion to accept, decline, or remove any person on a Expedition. CR and CRW reserve the right, without penalty, to make changes in the published itinerary whenever, in their judgment, they deem it necessary for your comfort, convenience, or safety and in accordance with these Terms.

LIABILITY

CR WILD, ITS PARENTS, SUBSIDIARIES, AND THEIR RESPECTIVE EMPLOYEES, AFFILIATES, OFFICERS, DIRECTORS, SUCCESSORS, REPRESENTATIVES, AND ASSIGNEES (COLLECTIVELY DEFINED AS "CR WILD") ARE NOT LIABLE AND WILL NOT ASSUME RESPONSIBILITY FOR ANY CLAIMS, LOSSES, DAMAGES, COSTS, OR EXPENSES ARISING OUT OF INCONVENIENCE, LOSS OF ENJOYMENT, UPSET, DISAPPOINTMENT, DISTRESS, OR FRUSTRATION, WHETHER PHYSICAL OR MENTAL, RESULTING FROM THE ACT OR OMISSION OF ANY PARTY.

 

Cr Wild shall not be held liable for:

(A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and

(B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control.

You waive any claim against Cr Wild for any such loss, damage, injury, or death.
